Leading Experts to Gather for Conference on the Role of Hedge Funds and Private Equity Funds in Corporate Restructuring Transactions at Cardozo School of Law; Harvey R. Miller to Deliver Keynote

Prominent and influential members of the corporate restructuring field will participate in “Perspectives on Corporate Restructurings: The Impact of Hedge Funds in Corporate Restructuring Transactions” to be held at the Benjamin N. Cardozo School of Law/Yeshiva University at 55 Fifth Avenue at 12th Street on Monday, March 5 from 12:30p.m.-6:00p.m. For more information or to register, please call (212) 790-0257, e-mail heymancenter@yu.edu, or visit www.heyman-center.org.

The involvement of hedge funds in the distressed debt market is making corporate restructuring negotiations more complex and acrimonious. Frustrated by hedge funds that appear more interested in creating a trading market for distressed securities than agreeing on a restructuring plan, distressed companies are increasingly looking to private equity funds to rescue them. What is the impact of this trend on corporate restructuring transactions? Is this what chapter 11 intended? Are companies being harmed by the trading practices of hedge funds or helped by the liquidity they provide?

Drawing leaders from the fields of law, business and finance, confirmed speakers include:

           Timothy Coleman, The Blackstone Group
Chaim J. Fortgang, Silver Point Capital Advisors, LLC
Jonathan S. Henes, Kirkland & Ellis LLP
Gary T. Holtzer, Weil, Gotshal & Manges LLP
David S. Kurtz, Lazard Freres & Co. LLC
Howard M. Levkowitz, Tennenbaum Capital Partners, LLC
James A. Mesterharm, Jay Alix & Associates.
           J. Gregory Milmoe, Skadden, Arps, Slate, Meagher & Flom LLP
           David Pauker, Goldin Associates, LLC

In addition, Harvey R. Miller, Managing Director and Vice Chairman, Greenhill & Co., LLC, will deliver the keynote address on the impact of hedge funds and private equity funds on corporate restructurings.

The conference is organized by The Samuel and Ronnie Heyman Center on Corporate Governance, founded at the Benjamin N. Cardozo Law School in 1987 to promote the study and discussion of the role of corporate enterprises and managerial activity in contemporary society. The Heyman Center seeks to raise public and academic awareness of cutting-edge corporate and securities law issues by sponsoring symposia and lectures by prominent legal scholars and political and business leaders and by supporting faculty and student research programs. The director of The Heyman Center is Prof. Eric J. Pan, who can be reached at 212-790-0831.
